SHAEP ELITE PRIVACY POLICY — Kelsey Rose Fitness Inc. | Effective date: May 6, 2025

This is the Privacy Policy of Kelsey Rose Fitness Inc. (“us,” “we,” or “Kelsey Rose Fitness”). This policy describes how your personal information is collected, used, and shared when you use shaep Elite, available at shaep.co or through our branded apps (the “Service”). By using the Service, you agree to this policy. We may update it from time to time; continued use constitutes acceptance.

Information we collect

We collect information you provide directly (name, email, password, profile details), payment information processed securely through third-party vendors, health and fitness data (workout activity, exercise logs, progress metrics) with your explicit consent, and information collected automatically (IP address, device type, app usage, location where permitted).

How we use your information

We use your information to deliver and personalize fitness content and programs, process transactions, provide customer support, send communications and marketing (where you’ve opted in), analyze and improve the Service, prevent fraud, and enforce our legal rights. We do not sell your data to third parties.

Health data utilization

Our app collects and processes health-related information such as workout activity, exercise logs, heart rate, and other fitness metrics. This data is collected only with your explicit consent and is used exclusively to deliver core app features, including fitness tracking, progress insights, and cross-device synchronization. We do not share your health data with any third parties, and we do not use this data for advertising or marketing purposes. All health information is stored securely and access is limited to authorized personnel only. We adhere to industry best practices to ensure data protection. If you choose to delete your account, all associated personal and health-related data will be permanently deleted from our systems.

Disclosures to third parties

We share your information only with authorized service providers necessary to operate the Service. Our primary fitness platform infrastructure is powered by Everfit (everfit.io/privacy), which enables workout delivery, client management, and progress tracking. Other providers include payment processors, email platforms, and analytics tools. All are contractually bound to protect your data. We may also disclose information when required by law, or in connection with a business transfer (with prior notice to you). We will never share your health or fitness data for advertising, insurance, or employment purposes.

Targeted advertising

We may use your information for targeted advertising. You can opt out via the Digital Advertising Alliance (optout.aboutads.info), AppChoices (youradchoices.com/appchoices), or through Google and Facebook ad settings. You may also restrict tracking through your browser or device settings.

Emails

You will receive transactional emails related to your account and purchases — these cannot be opted out of. Marketing emails can be opted out of at any time via your account settings or the unsubscribe link in any email.

Your privacy rights

You may update or close your account at any time via your account settings. EEA users have the right to access, correct, delete, restrict, or object to use of their personal data — contact us to exercise these rights. California residents (CCPA) may request access to, deletion of, or opt out of the sale of their personal information. Nevada residents may opt out of the sale of covered information; we do not currently sell such information.

Account deletion

To request the deletion of your personal information from our database, you can submit a request through our in-app settings or contact form available on our platform. For such requests, please write “delete my account” in the subject line, and include your first and last name and e-mail address in the body of the message. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for administrative purposes. Please note that we will store communications you may send through the Service, as well as any comments you may post, and they may not be subject to modification or deletion. You may also control the information that we collect through the settings in your browser or mobile device. You may configure your browser to reject cookies from our app and may adjust the settings of your mobile device to prevent the Platform from obtaining location information. However, please note that the Service may rely on cookies and location information to function properly and some parts of the Service may not be available if you disable cookies.

Children’s privacy

The Service is not intended for individuals under 16. If you believe a child has provided personal information without consent, please contact us immediately.

Changes

We may update this policy to reflect changes in our practices or legal requirements. Material changes will be communicated via the Platform or email.
